Reasons and legal basis for collecting personal data
We collect and process your personal data in line with the requirements and stipulations of the EU’s
General Data Protection Regulation (“GDPR”), the Bundesdatenschutzgesetzes (BDSG) and the Data
Protection Act 1998 as well any further relevant national laws. If you report a claim to us, we require
your personal data to be able to process it, particularly to assess if the claim is justified and to
assess the amount of compensation.
The legal basis for the collection and processing of personal data to protect our own vested interests
and those of third parties is set out in article 6.1 f) GDPR. Should we require certain further
categories of personal data to do so, we will seek your consent in accordance with article 9.2 a) GDPR.
In addition and in accordance with article 6.1.c) GDPR, we are required to collect, process and keep
records of your personal data to comply with legal obligations, for example under regulatory, commercial
and tax law. If we act as an external service provider for third parties, this work will be based on
appropriate agreements or your consent.
Who do we share personal information with? Data recipient categories
Insurers
We will send the relevant claims data to the appropriate insurance company to allow them to check
insurance cover and enable them to come to their own conclusion regarding the claim in question.
Internal transfer
Your personal data may be shared internally with teams involved in the proper functioning of our
business (e.g. accounts, finance, telecommunications and IT).
External service providers
To comply with our legal and contractual obligations we utilise the services of external service
providers, such as engineers, repair garages, treatment providers, medical experts, solicitors or other
specialists. You can request a list of all our service providers (other than temporary ones) we work
with at the address mention above.
Other recipients
We may also share your personal data with further parties, such as government departments to comply with
legal obligations (e.g. the FSA or the CPS).
How long do we keep records for?
We will delete your personal data as soon as we are no longer required to keep it for the reasons
aforementioned, if the deletion would not be detrimental to you in accordance with article 18.1 c) GDPR.
We may keep records up until the period expires when claims can be brought against our company, the
Motor Insurance Bureau, the insurer or their insured (limitation period between 3 and 6 years from date
of accident or knowledge).
We will also keep records of your personal data if we are required to do so by law, including duties to
retain records and requirements to provide proof under the German commercial code, fiscal and
money-laundering requirements and other national laws. The period for data retention lasts up to 10
years on average.
Sharing data with third party countries
In accordance with article 44 GDPR, we only share data with parties in a third party country, i.e. a
party outside of the European economic area, if it is strictly necessary to achieve our business
objective. An example would be if the relevant insurer is domiciled there.
Your rights
Right to disclosure
You are entitled to request information regarding your personal data we hold at the abovementioned
address. In certain circumstances, you are entitled to request correction or deletion of your personal
information. You may also be entitled to the disclosure of your data in a structured, up to date and
machine-readable format.
Right to object
In line with article 21.1 GDPR, you are entitled to object, for reasons attributable to your personal
circumstances, to us processing your personal data. If so, we will cease to do so, except where we can
show there are compelling reasons for protecting the data, which outweigh your personal interests,
rights and freedom or we where we need to process the data to pursue, exercise or defend our legal
rights.
